INSURANCE AND CLIENT LIABILITY WAIVER
Signing the activity records implies that the Client accepts the following conditions.
1 - Azorean Active Blueberry - Animação Turística, Unipessoal LDA (AAB), in accordance with current Portuguese law (Decree-Law No. 108/2009 of May 15, as amended by Decree-Law No. 95/2013 of July 19), is insured by Allianz Portugal, S.A., under Policy No. 206476308 for Civil Liability (€50,000) and Policy No. 206468261 for Personal Accidents (Death or permanent disability – €20,000; Medical expenses – €3,500).
2 - The Client acknowledges and fully understands that participation in AAB activities (including, but not limited to, canyoning, coasteering, among others) involves inherent risks and hazards, including but not limited to: walking on uneven terrain; changes in weather conditions that may result in slippery trails or surfaces; improper use of equipment and/or inappropriate conduct by the Client; falls; overexertion; vertigo; inability to remain within designated areas; and impact or collision with trees, other participants, or guides. The Client freely accepts and fully assumes all such risks and hazards described above, including the possibility of personal injury, disability or death, as well as damage to or loss of personal belongings (including, but not limited to, rings, earrings, necklaces, cameras, mobile phones, glasses, contact lenses, etc.), arising from risks and/or hazards inherent to participation in AAB activities.
3 - The Client undertakes to respect the environment and natural areas where the activity takes place and to minimize human impact as much as possible, including by not littering and by following designated paths and the guides’ instructions.
4 - The AAB guide(s) assigned to you may need to make decisions regarding safety. Compliance with and respect for the decisions made by the AAB representative is a condition of booking. Should you fail to follow the representative’s instructions, or if your conduct is incompatible with the overall enjoyment and well-being of other clients, we reserve the right to refuse your continued participation in the tour. In such cases, no refund, compensation, or coverage of any additional costs will be provided.
5 - The Client undertakes to behave in a manner that does not endanger themselves, other participants, or staff. The use of drugs or alcohol is strictly prohibited, and any person appearing to be under the influence will be removed from the activity without refund. AAB shall not be held responsible for the conduct of other clients participating in the tour or for any damage to any facilities caused by such conduct.
6 - Due to the nature of the activities, the Client declares that they are fully aware of the associated risks and confirms that they are in PERFECT PHYSICAL AND MENTAL HEALTH AND NOT PREGNANT. The Client further declares that they possess basic skills and confidence in an aquatic environment. The Client must inform AAB of any serious or chronic illness or any allergies that may increase the risks associated with the activity. The company reserves the right, on site, to refuse participation to any person who does not demonstrate adequate physical condition and/or mobility for the activity, or whose participation may compromise their own safety or that of the group.
7 - This Insurance, Liability Waiver and Release, as well as the rights, duties, and obligations contained herein, shall be governed by and construed exclusively in accordance with Portuguese law, and no other jurisdiction.
8 - The Client agrees to defend, release, and indemnify AAB from and against any and all liability arising from property damage or personal injury caused to third parties as a result of the Client’s participation in the activities.
9 - Any images captured during our activities may be used by the company for promotional purposes, including but not limited to catalogs, posters, videos, and online publication. Such images will always respect the Client’s dignity.
10 - AAB may disclose Client information to the extent required by law, in connection with any legal process or proceedings, and for the purpose of establishing, exercising, or defending its legal rights, as well as for the sale of any product or equipment management. Except as stated in this paragraph, we will not disclose your information to third parties.
11 - I sign to confirm that I have been informed of all important information regarding the activity, including safety conditions and rules, operation, and communication, as explained verbally by the guides.
